An ordinance fixing the opening and closing time of the public market gates

BE ENACTED by the Sangguniang Bayan of the Municipality of Cabatuan, in session and assembled that:

SECTION 1. TITLE – an ordinance regulating and fixing the opening and closing time of the gates in the public market of the Municipality of Cabatuan.

SECTION 2. SCOPE – This ordinance covers all the gates within the premises of the Cabatuan Public Market.

SECTION 3. DEFINITION OF TERMS:

Public Market – refers to the existing market or place of business operated by the Municipality and extended up to the lower portion of the business area.

Gates – structures constructed and attached to the wallings of the market for the purpose of securing the physical properties of the Municipality and of the market vendors.

SECTION 4. IMPLEMENTATION/ENFORCEMENT – There is hereby enforced and implemented the opening and closing time of all existing gates in the public market in the following manner:

Upper Portion: Opening time - 3:00 A.M. Closing time - 9:00 P.M.

Lower Portion: Opening time - 2:00 A.M. Closing time - 9:00 P.M.

Schedules for the opening time of the gates mentioned herein shall not be applied during market days or special occasions provided a formal request be made addressed to the Municipal Mayor through the Market Supervisor which shall be regulated in the following hour:

Upper portion - 2:30 A.M. Lower portion - 1:00 A.M.

SECTION 5. MISCELLANEOUS PROVISIONS:

There shall be an Identification Cards to be issued and required to all transient vendors who are within the premises of the public market during this regulating hours. It further required that said identification card shall at all times be ready for inspection by the market guards or any person duly authorized to do such inspection.

It is likewise prohibited for any transient vendor to roam around within the premises of the market until the gates have been opened.

SECTION 6. PENALTY – Any person found roaming or keeping himself astray in the premises of the public market without any valid reason and except on emergency cases shall be punished by a fine of One Thousand (P1,000.00) Pesos and/or imprisonment of not less than thirty (30) days at the discretion of the Court.

The above penalty shall not relieve any violator of this ordinance from any civil liability he may have caused or the Court may meted out against him.

SECTION 7. REPEALING CLAUSE – any existing ordinances whose provisions are inconsistent with the provisions of this ordinance are hereby repealed or modified accordingly.

SECTION 8. EFFECTIVITY CLAUSE – This ordinance shall take effect after its approval.
