MUNICIPAL ORDINANCE NO. 2007-001
AN ORDINANCE IMPOSING FEES ON THE ISSUANCE OF TENDER DOCUMENTS BY THE BIDS AND AWARDS COMMITTEE OF THE MUNICIPALITY OF CABATUAN, ILOILO
WHEREAS, Republic Act of 9184 otherwise known as the Government Procurement Reform Act provides for the modernization, standardization and regulation of the procurement activities in the government and other purposes;
WHEREAS, this Act establishes governing principles on government procurement, standardizes, procurement process and forms, including the establishment and professionalization of the Bids and Awards Committee (BAC) in each procuring entity;
WHEREAS, the functions of the Bids and Awards Committee are the following: advertise or post invitation to bid, conduct procurement and pre-bid conferences, determine the eligibility of prospective bidders, receive bids, conduct the evaluation of bids, undertake post qualification proceedings, and recommend award of contracts to the head of the procuring entity;
WHEREAS, the Invitation to Bid is prepared based on the bidding documents and there is a need to compensate the Municipality of these expenses in the reproduction of the bidding documents;
NOW, THEREFORE, upon motion of Honorable Louvenn C. Leyso, duly seconded by Honorable Reginaldo C. Nandin and Honorable Angel C. Aguero,
BE IT ENACTED by the Sangguniang Bayan, in session that:
SECTION I. That fees shall be imposed on the issuance of Tender Documents by the Bids and Awards Committee of the Municipality of Cabatuan, Iloilo, on the following schedule:
A. Goods:

0.00 - 100,000.00 - P100.00
100,001.00 – 200,000.00 - 200.00
200,001.00 – 300,000.00 - 250.00
300,001.00 – 400,000.00 - 300.00
400,001.00 – 500,000.00 - 350.00
500,001.00 – 1 Million and above-
above but not exceeding
5 million pesos- 500.00
5 million and above - 1,000.00
B. Infrastructure and Consultancy

C. Sale of BAC Minutes and BAC Resolutions will be P20.00 per page.
Section II. That Five Hundred Pesos (P500.00) shall be imposed as a pre-qualification fee on suppliers and contractors;
Section III. That this ordinance shall modify and repeal any existing ordinance;
Section IV. This ordinance shall take effect after ten (10) days from its approval and posting;
