MUNICIPAL ORDINANCE NO. 2007-006

ORDINANCE PROHIBITING MOTOR VEHICLES, PEDICABS AND REGULATING THE ENTRY AND PASSING THROUGH OF BICYCLES, ROLLER SKATES, SKATEBOARDS AND THE LIKE IN THE TOWN PLAZA

Be it Ordained by the Sangguniang Bayan in session duly assembled that:

Section 1. No motor vehicle and pedicab may enter or pass through the town plaza at all times.

Section 2. Bicycles, roller skates, skate boards and the like may enter the town plaza only within the premises of “designated area”.

Section 3. Exemption:
Those who are in need of the use of wheelchairs and strollers are exempted from the provisions of this Ordinance.

Section 4. Definition of Terms:
a. Motor Vehicle – a self-propelled wheeled conveyance, such as, but not limited to, cars, motorcycles, tricycles, that does not run on rails.
b. Pedicab – a three wheeled public utility vehicle otherwise known as “trisikad”.
c. Bicycle – a vehicle consisting of a light frame mounted on two wire-spoked wheels, one behind the other and having a seat, handlebars for steering, brakes, and two pedals or a small motor by which it is driven.
d. Roller Skates – devices tucked to the feet to enable the wearer to glide along on wheels, propelled by the legs.
e. Skateboard – a short narrow board having a set of four wheels mounted under it, ridden by a person in a standing or crouching position and often used to perform stunts.
f. Wheel Chair – a mobile chair mounted between large wheels, for the use of invalids.
g. Stroller – a small light baby carriage, often collapsible.
h. Designated Area – the area along Bermejo street with a dimension of 13 meters x 27 meters or an area of 351 square meters surrounding the Bonifacio Monument, or otherwise known as “The Freedom Park”.

Section 5. Penalty Clause – the owner and/or driver/rider who violates this ordinance shall be fined Three Hundred Pesos (P300.00) or an imprisonment of two (2) days, or both, at the discretion of the Court.
Section 6. This Ordinance shall be implemented by the Philippine National Police and under the supervision of the Local Chief Executive.
Section 7. Repealing Clause – this Ordinance hereby repeals any existing ordinance inconsistent with this Ordinance.
Section 8. Effectivity Clause – This Ordinance shall take effect after 10 days from its approval and having been posted in 3 conspicuous places for ten (10) days.
